Terms & Conditions
By making a ‘reservation’ or ‘booking’ with Silverpoint Accommodation, or joining our loyalty program, you unambiguously acknowledge you are bound by the following terms. Should you have any issues with these terms, please contact us.
The following terms, which may be referred to throughout as ‘these terms’, ‘terms’ ‘conditions’ or ‘terms and conditions’ apply to all bookings made through any distribution channel.
Who are we:
Silverpoint Accommodation and/or Silverpoint Estate (ABN: 23 665 055 094) is a registered Bed & Breakfast located in Pokolbin/Rothbury, NSW 2320 and may be represented below using the terms ‘Silverpoint’, ‘us’, ‘we’ and ‘our’.
Check in/out times:
Check in is available from 2:00pm and check out is at 10:00am. Whilst alternative arrangements may be requested, they are subject to availability and may incur an additional fee. For late check outs where arrangements have not been made, the following fees may be charged to the card provided in the booking: up to 12:00pm (noon), 25% of the rate for the day. After 12:00pm, the full daily rate is applicable.
Guest count:
As per the governing regulations on Bed & Breakfasts, there is a maximum of 6 “persons” permitted in any booking – including children, who must be specified in the count during the booking process. As this limit is legally imposed on us, we cannot and will not make any exceptions or exemptions to this policy. The property is reserved for the use of overnight guests only and 'visitors' are not permitted without prior approval from management, which will not necessarily be granted.
Pets & smoking:
Unfortunately, Silverpoint Accommodation does not permit pets on site and smoking is not permitted on the property. You will be held liable for all damages resulting from pets and/or smoking, which may be recovered by us using the details you provide with your booking.
Cancellations & Changes:
Cancellation/Change/Refund policies vary across the different websites, please check for any policies stated on the website through which you are booking as these will take precedence. For bookings made on our websites, and as a general default where there is ambiguity, the cancellation policy will be as follows: For cancellations/changes made outside of 30 days prior to arrival, a full refund will be issued. Cancellations/changes made within 30 days will result in no refund being issued, with the full amount being retained by us. Silverpoint Accommodation reserves the right to charge you (using the details you have provided to us) for any monies owing, at anytime before, during, or after your reservation date without advance notice. Extraordinary circumstances may be considered, however Silverpoint holds the absolute authority over these conditions and no discussion will be entered into once a decision has been made.
Payments:
Full payment is required at the time of booking in all circumstances unless EXPLICITY stated otherwise. In cases where payments are manually processed by us, we reserve the right to process them at any time after the booking is recieved. We will process payments through systems we deem to be of a high security standard and will handle any information in acccordance with our privacy policy. We cannot provide any guarantee of the security of your details within third party systems and, as outlined in the limitation of liability will accept no responsibility of any losses resulting from the actions of these third party payment providers. Should any issues arise from the process, damages should be sought from the relevant provider directly (details can be found in our privacy policy, or by contacting us).
Should your card be declined, we will provide you 24hrs to resolve the issue after which time we may cancel your booking. In cases where the provider through which you booked has other requirements, we will follow these procedures. Bookings cancelled in this manner will attract the same conditions as outlined under the ‘cancellations’ heading in this document. This fee may be charged at any time after the minimum waiting time specified above.
Loyalty Program Membership:
By joining our loyalty program you acknowledge and agree to the information you provide being used, in accordance with our privacy policy, to send you information relating to our products & services. This may include newsletters, special annoucements and sale information. Should you wish to leave the program, click unsubscribe in the welcome (or any subsequent) emails you receive from us.
Loyalty Program Benefits:
Any inclusions and discounts are valid only on bookings made through the channels indicated in the description (e.g. official website, Facebook, all). Inclusions or discounts available on any qualifying reservation shall be those advertised at the time of your booking and any changes we make after your reservation will not be retrospectively applied. Any images displayed are intended to give an impression of the inclusion only and may not show exactly what is included. Where inclusions involve liaising with a third-party, we cannot be held liable for any delay or breakdown in communication that may result in an inability to deliver your inclusion. In such cases, we shall attempt to provide a substitute, up to the value of the original inclusion where possible. Where there is limited availability, you accept that there may be circumstances in which it is not possible for us meet your preferences, however we will try and arrange alternative possibilities for you. Finally, should we request any information to be provided in order to organise inclusions, you acknowledge that it is your responsibility to provide such information in a timely manner and that any issues that arise as a result in a delayed response are your responsibility and we are not obliged to provide any alternative arrangements. In any case, any alternatives or arrangements shall not exceed the value (determined at list price) of the original inclusions at the time of booking. We will accept no liability for anything that may happen during, as a result of or in relation to any of our inclusions where they are from third parties. Please see the relevant terms or policies from the provider for more information on how they handle such incidents.
Booking extras:
Any booking extras selected during the checkout process will be treated, for the purposes of these terms as the same as Loyalty program benefits. Additionally to these however, where they have been paid for explicitly at the time of booking, and for whatever reason cannot be provided, a full refund of the amount paid for the item will be issued. No compensation will be provided for any losses resulting from the failure to provide these items.
Bookings with third-parties:
All bookings made through third party organisations (i.e. not through www.silverpoint.net.au or “Book Now” feature on our Facebook page www.facebook.com/silverpointaccommodation) will be subject to any terms displayed on these sites. Where a link is provided to this page, these terms will also apply and will form the primary set, meaning should any discrepancies occur, this document will prevail. Where this document is not provided becuase of limitations imposed on us by the channel provider, we will endevour to configure the settings provided to us in accordance with this document, and will follow the procedures outlined herin.
Breaches of these terms:
Silverpoint reserves the right to cancel bookings where guests breach these terms. Refunds will be issued where deemed appropriate, in accordance with the cancellations terms above. Any serious breach that occurs onsite may result in eviction from the premises as it is private property, use of which is provided to you only on the basis of these terms & conditions.
Limitation of liability:
Under no circumstances shall Silverpoint Accommodation be liable to you or any party related to you for any indirect, incidental, consequential, special, exemplary, or punitive damages or loss of profits, even if Silverpoint has been advised of the possibility of such damages. While we will attempt to minimise and mitigate all risks, we are in no way liable for injury or death that occurs as a result of your booking or while you are on the property to the maximum extent permitted by law. Your safety is ultimately your responsibility. In any event, our total aggregate liability to you for all damages of every kind and type (regardless of whether based in contract or tort) shall not exceed the total amount tendered for your booking.
Severability:
The invalidity or unenforceability of any provisions of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement, which shall remain in full force and effect.
Privacy:
We will endeavour to maintain maximum privacy of all information provided to us in association with any booking. However, where necessary, we will share this information with businesses, as required, to carry out booking, payment or legal activities and to law enforcement agencies where required. Alterations:
We reserve the right to update these terms, or otherwise make any changes where we deem necessary. From the time updates are reflected on our website, they will represent the binding set of terms. We are not obliged to notify you of any changes in any other way. We may also alter tariffs, run promotions and alter the available facilities without notice.
